Welcome to Hikerbabes! These Terms & Conditions (“Terms”) govern your use of our website, participation in our events, and engagement with our community. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms
 

By using the Hikerbabes website (hikerbabescommunity.com), registering for our events, or participating in our community activities, you agree to these Terms & Conditions. If you do not agree, please do not use our services.

2. Eligibility
 

a. Membership:

  • Hikerbabes is a community for women who share a passion for outdoor activities. Membership is open to all women aged 18 and older.

b. Participation:

  • By participating in any Hikerbabes event, you confirm that you meet the eligibility criteria, are in good health, and have the physical capacity to participate in the activities.​

a. Event Registration:

  • To participate in our events, you must register through our website or an authorized platform. Registration may require payment, and all fees are due at the time of booking unless otherwise specified.

a. Respect and Inclusion:

  • Hikerbabes is committed to fostering a respectful and inclusive community. Discrimination, harassment, or any behavior that undermines the safety and well-being of others will not be tolerated.

b. Safety:

  • Participants are expected to follow all safety guidelines provided by Hikerbabes staff or event organizers. This includes adhering to any instructions regarding hiking routes, weather conditions, and the use of equipment.

c. Responsibility:

  • You are responsible for your own safety and well-being during Hikerbabes events. You agree to act responsibly and take necessary precautions to protect yourself and others.

     

5. Assumption of Risk and Liability Waiver
 

a. Acknowledgment of Risks:

  • Outdoor activities, including hiking and travel, involve inherent risks, including but not limited to injury, illness, or accidents. By participating in Hikerbabes events, you acknowledge and accept these risks.

b. Mandatory Liability Waiver:

  • All members and participants in Hikerbabes events are required to sign a Liability Waiver prior to participating in any activity. The waiver is a legal document that releases Hikerbabes, its organizers, and affiliates from liability for any injuries, losses, or damages that may occur during or as a result of participation in our events.

  • Failure to sign the Liability Waiver will result in your inability to participate in Hikerbabes events.

a. Ownership:

  • All content on the Hikerbabes website, including text, images, logos, and graphics, is the property of Hikerbabes or its content suppliers and is protected by intellectual property laws.

b. Use of Content:

  • You may not reproduce, distribute, or create derivative works from our content without prior written consent. This includes using our name, logo, or images for any commercial purpose.

     

7. User-Generated Content
 

a. Contributions:

  • We may allow users to post content, such as comments, photos, or reviews. By submitting content, you grant Hikerbabes a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and distribute your content.

b. Responsibility:

  • You are solely responsible for the content you post. You agree not to post anything that is unlawful, harmful, defamatory, or otherwise objectionable. Hikerbabes reserves the right to remove any content that violates these Terms.

a. Privacy Policy:

  • Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

     

9. Photography and Media
 

a. Image Use:

  • As outlined in our Image Policy, photographs and videos may be taken during our events and used for promotional purposes. By participating in our events, you consent to this use.

  • Our website may contain links to third-party websites that are not operated by Hikerbabes. We are not responsible for the content, privacy policies, or practices of any third-party sites.

b. Affiliates and Partners:

  • Hikerbabes may partner with other organizations or companies to offer additional services. These partnerships will be clearly disclosed, and any transactions with these third parties are governed by their own terms and conditions.

     

11. Modifications to Terms
 

a. Changes:

  • Hikerbabes reserves the right to modify these Terms at any time. Any changes will be posted on this page, and the “Effective Date” will be updated. Continued use of our services after changes are made constitutes acceptance of the new Terms.

     

12. Dispute Resolution
 

a. Informal Resolution:

  • In the event of any dispute, claim, or controversy arising out of or relating to these Terms & Conditions, the parties agree to first attempt to resolve the matter informally by contacting Hikerbabes directly.

b. Mediation:

  • If the dispute cannot be resolved informally, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator. The mediation will take place in Oregon (USA), and the costs will be shared equally by both parties.

c. Arbitration:

  • If mediation fails, the dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration will be conducted in Oregon (USA), and the arbitrator’s decision will be final and binding.

     

13. Limitation of Liability
 

To the fullest extent permitted by law, Hikerbabes, its organizers, affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services or participation in our events, whether based in contract, tort, strict liability, or otherwise, even if Hikerbabes has been advised of the possibility of such damages. In no event shall Hikerbabes' total liability to you for all claims arising out of or related to these Terms exceed the amount paid by you, if any, for participating in Hikerbabes events.

 

14. Termination of Membership or Participation
 

a. Termination by Hikerbabes:

  • Hikerbabes reserves the right to terminate your membership or participation in any event at its sole discretion, without notice, if you violate these Terms & Conditions, engage in behavior that is harmful to other participants or the community, or for any other reason deemed appropriate by Hikerbabes.

b. Termination by Member:

  • You may terminate your membership or withdraw from any event at any time by contacting Hikerbabes. However, refunds are subject to the cancellation policy outlined during the registration process.

c. Effects of Termination:

  • Upon termination, your right to use Hikerbabes services will immediately cease. Any outstanding obligations you have to Hikerbabes, including payment of fees, will survive termination.

     

15. Severability
 

If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

 

16. Choice of Law
 

These Terms & Conditions and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Oregon (USA), without regard to its conflict of law principles. Any legal actions or proceedings shall be brought exclusively in the courts located in Oregon (USA).
